Is there A benefit to An Outside Notary?

 

Yes, there is. Simply put, they have no skin in the game.

They don’t care one way or another if Client 1 and Client 2 are friends, enemies, or otherwise. They are simply at the venue to ensure that all parties involved are who they claim to be, everyone understands the general idea of what they are agreeing to (in writing), and no one feels pressured or intimidated to sign/initial the documents before them.

A lot of times, locations that ‘appear’ to prey on the misfortune of others (you all know the places that I will not mention here), have their own in-house notary. The salesman/saleswoman will rush a deal, then push the ‘client’ off to a manager/supervisor to finalize the deal. The only problem with this, the notary in this situation has a direct interest in the deal going through (if the notary is the financial manager/assistant) and therefore cannot be impartial to the transaction.

If someone else in the company, not directly involved in the deal is chosen to notarize the paperwork, then it is not a conflict of interest, but why take the chance? The main thing to remember is…will the notary be truly impartial in MY particular situation?

The duty of the notary is to ensure the fraudulent activity is not taking place, everyone is who they claim to be, and no one is signing under fear or intimidation or undue stress.

If down the road, someone thinks that there was some undue influence to sign a document, you can bet that the document in question will find its way into a courtroom, or at a minimum, a mediation/arbitration office, followed by exorbitant fees, and a lot of headaches, followed by more money (for Tylenol).
